Pavedimo mokėjimo paskirtyje turi būti nurodoma „užtikrinimas, konkursinio objekto adresas“
1. Dalyvių, kurių Pasiūlymai nebus išrinkti arba bus atmesti procedūros metu, užtikrinimą LD grąžins per 21 (dvidešimt vieną) kalendorinę dieną nuo Komisijos sprendimo priėmimo išrinkti kito dalyvio Pasiūlymą laimėtoju arba atmesti Pasiūlymą.
2. Patvirtinus Dalyvį laimėtoju, jo pavedimu sumokėtas užtikrinimas bus įskaitytas į Nekilnojamojo turto kainą. Informaciją apie apklausos pabaigą ir konkursą laimėjusio Dalyvio (laimėtojo) sumokėto užtikrinimo dydį kartu su atitinkamų dokumentų kopijomis, patvirtinančiomis konkurso baigimą, TVK perduoda NTV per 21 (dvidešimt vieną) kalendorinę dieną nuo tada, kai:
1) TVK priėmė nutarimą dėl konkurso baigimo, Dalyvio išrinkimo ir Nekilnojamojo turto Pardavimo kainos patvirtinimo, kai dėl Nekilnojamojo turto nereikalingi papildomi Bendrovės valdymo organų sprendimai ar pritarimai;
2) paskutinis iš numatytų Tvarkoje, Bendrovės įstatuose ar teisės aktuose Bendrovės valdymo organas priėmė nutarimą, kuriuo nusprendė arba pritarė dėl Nekilnojamojo turto pardavimo – kai dėl Nekilnojamojo turto reikalingi papildomi Bendrovės valdymo
organų sprendimai ar pritarimai.
3. Jei Dalyvis pateikė užtikrinimą banko garantijos forma, garantijos dokumentas grąžinamas, sumokėjus Nekilnojamojo turto kainą, atmetus Pasiūlymą arba išrinkus kitą Pasiūlymą.
4. LD turi teisę negrąžinti užtikrinimo arba prašyti įvykdyti reikalavimus pagal banko garantiją, jei Dalyvis, kurio Pasiūlymas buvo išrinktas konkurso metu laimėtoju, atsisakė sudaryti Sutartį. Informaciją apie Dalyvio atsisakymą sudaryti Sutartį ir informaciją apie galimą užtikrinimo grąžinimą TVK perduoda NTV nedelsdama.
5. Pirkėjas įpareigotas sumokėti Pardavimo kainą į Bendrovės nurodytą banko atsiskaitomąją sąskaitą arba sumokėti kainą į notaro atidarytą depozitinę sąskaitą ne vėliau kaip Sutarties sudarymo dieną. Jei pirkėjas sumoka visą kainą arba kainos dalį iš banko kredito lėšų, kainos dalis gali būti sumokama po Sutarties sudarymo, jei pirkėjas iki Sutarties sudarymo pateikė banko įsipareigojimą suteikti kreditą ir Sutartyje yra numatyta, kad pirkėjas sutinka, jog visa Nekilnojamojo turto Pardavimo kaina gali būti iš jo išieškota. Be to, pagrįstais atvejais, TVK gali priimti sprendimą dėl išvardytų reikalavimų, įskaitant kitus užtikrinimus, ypač Nekilnojamojo turto atpirkimo teisę ar Nekilnojamojo turto apsaugą hipotekos forma, netaikymo.
